To obtain a copy of a criminal report?
The Kansas Open Records Act
This information is to inform the public of their rights under the Kansas Open Records Act (KORA), found at KSA 45-215 through 45-223, with regards to information maintained by the
Salina Police Department. The Chief of Police is the official custodian of all records kept and maintained by the Salina Police Department. Public records shall be open for inspection by any person, unless otherwise provided by the act.
Original records cannot be removed from the Salina Police Department. Requests for inspection of records must be submitted to the Records Bureau. Most records will be produced within three business days from the time the request is
received. If the request is delayed or denied, a written explanation for the delay or denial will be provided within those three days.
Open Records
The following Salina Police Department records are considered public records:
- Standard Offense Report
- Accident Reports
- Incident Reports
- Statistics
Exceptions
*KSA 45-221(a)(10) allows discretionary closure of criminal investigative records if the release would "interfere with any prospective law enforcement action, criminal investigation or prosecution" *KSA 45-221(a)(30) allows
discretionary closure of public records containing information of a personal nature where the public disclosure thereof would constitute a clearly unwarranted invasion of personal privacy.
Records Not Public
The following Police Department records are exceptions to KORA and COPIES* are not available to the public:
- Search Warrants
- Arrest Warrants
- Arrest Reports
- Personnel Records
- Criminal Investigations Records*
- Laboratory files
- Undercover agent or informant information
- Civil litigation records
- Correspondence with a private individual
- Information individually identifying a victim of a sex offense
- 911 Records or Recordings require a court order
- *Video including Officer Body Camera and Dash Camera Video require a court order
For a copy of a criminal report, complete the Request for Information form and submit it online to the Salina
Police Department Records Unit. The Records Unit is open for business Mon-Fri., 8 am to 4:30 pm, excluding holidays. The address is: 255 N. 10th St., P.O. Box 1154, Salina KS 67401. Please be advised once the request has been received,
the Records Unit has 72 business hours (not counting the day it was received) to respond to the request.
